Welcome to the Elder & Special Needs Law Section
The Elder & Special Needs Law Section focuses on
issues related to the elderly population of North Carolina i.e.,
Medicare and Medicaid. The section, currently with 570
sponsors CLE programs and services; provides members with a
substantive newsletter, Elder Law; and helps mold the association's
legislative agenda for presentation to the N.C. General
Rather than being defined by technical legal distinctions, elder law is best defined by the client being served. It is critical to recognize the special planning needs of the elderly, the importance of advance directives to their safety, housing and long term care needs. It is also important to recognize the ethical issues facing an attorney dealing with clients with diminished capacity and frequent multi-generational participation in their care and planning. This involves issues of not only Medicare and Medicaid, but also disability, guardianships or other means of asset management, health care through community based services, assisted living, nursing home care and rehabilitation care. The Elder & Special Needs Law Section seeks to educate and assist attorneys, other professionals and the general public with these issues.

Continuing Legal Education (CLE) - contains section-specific Continuing Legal Education (CLE) information including upcoming programs and publications when available.
Governance - contains the Elder & Special Needs Law Section's governing documents including the purpose statement and bylaws.
Join/Renew - contains an online application form for joining this section.
Leadership - contains information from the section's leadership including the section officers, section council, committee chairs, and meeting minutes when available.
ListManager – is a communication tool that offers its members the opportunity to post suggestions, comments or questions to a large number of people at the same time.
Newsletters - contains the section's newsletters, which may be password-protected as determined by the section leadership.
Resources - contains section-specific legal resources including access to Fastcase® / PJI, online links / references, publications (e.g., forms, brochures, booklets, etc.), articles, legislative issues, and other information when available.
